Open Casting Participation Terms & Media Release
These terms apply when you register for or attend an Evergreen Talents open casting. Evergreen Talents is operated by EMA19 Holdings Sdn. Bhd. (Registration No. 202401039598 / 1585445-P) ("Evergreen Talents", "we", "us", "our"). When you tick the box on the registration form, you confirm that you have read and agree to these terms.
These terms are specific to open castings. Our general Terms of Use and Privacy Policy also apply.
1. What an open casting is
An open casting is a free, in-person session where our team meets new faces, takes a short look at how you present on camera, and talks with you about modelling. Attendance is free of charge.
Attending an open casting is not an audition for a specific job, and it does not create any agreement between us. It does not guarantee representation, signing, bookings, paid work, or a place on any training programme. Any representation, booking or programme is arranged separately and in writing at the time.
2. Who can attend
You must register in advance and give accurate information about yourself. If you are under 18, you must attend with a parent or legal guardian, and that parent or guardian must agree to these terms on your behalf. We may ask for written confirmation of guardian consent, and we may decline participation if it is not provided.
3. Photography and recording at the casting
During an open casting we may take photographs and record video and audio. This normally includes a short piece to camera, simple posture and walking footage, and general photography or video of the session and the room, in which you may appear.
We record this material for two reasons: to assess and keep a record of the people who attend, and to show what our castings and our agency are like.
4. Media release — what you are agreeing to
By agreeing to these terms, you give Evergreen Talents a non-exclusive, royalty-free licence to use the photographs, video, audio and your name, image, likeness and voice recorded at the open casting, for the following purposes only:
- marketing and promotion of Evergreen Talents and its own programmes and services;
- our own website, social media accounts, advertising, printed materials and showreels;
- presenting you to potential clients where we are considering you for representation or a booking; and
- our internal records and casting assessments.
This licence is worldwide, because the internet and social media are not limited by country. It applies for as long as we use the material, unless you withdraw your consent under clause 6.
You are not entitled to payment for this use, and you agree that we own the photographs and recordings themselves as the party that created them.
5. What we will not do
We will not:
- sell, rent or license your casting footage to a third party for that third party's own advertising, without asking you separately first;
- use the material in a way that is defamatory, sexual, or that misrepresents who you are or what you said;
- use it to suggest that you endorse a brand or product you have not agreed to endorse; or
- publish your phone number, home address, identity-document details or date of birth.
If we want to use your material for anything outside clause 4 — for example a paid brand campaign — we will ask you separately, and you are free to say no.
6. Withdrawing your consent
You can withdraw your consent to the media release at any time, for any reason, by emailing [email protected] or messaging us on WhatsApp at 011-6117 3226. Tell us your full name and roughly when you attended so we can find your file.
When you withdraw consent, we will stop using the material going forward and remove it from our website and our own social media accounts within a reasonable period. Please note two practical limits: material that has already been printed, broadcast, or shared or re-posted by other people may not be possible to recall, and we may keep a copy in our internal records where we are required or permitted to do so by law.
Withdrawing consent for the media release does not remove you from our talent database. If you also want your data deleted, see clause 7.
7. Your personal data
We collect and process your personal data under the Personal Data Protection Act 2010. In connection with an open casting we typically collect your name, contact details, date of birth or age, basic measurements and appearance details, and the photographs and recordings described above.
We use this to run the casting, to assess and contact you about representation and our programmes, to keep our talent records, and — where you have given the separate communications consent on the registration form — to send you updates by WhatsApp, SMS and email. That communications consent is separate from this media release, and you can opt out of messages at any time by replying STOP or using the unsubscribe link, without affecting anything else.
We keep your data for as long as you are an active contact of the agency, and for a reasonable period afterwards for our records. You may ask us at any time to access, correct, limit the use of, or delete your personal data by contacting [email protected].
8. Conduct and safety at the casting
Please follow the reasonable instructions of our team while at the venue. We may ask anyone to leave who behaves in a way that is unsafe, disruptive, or disrespectful to our team or to other attendees. You attend at your own risk and are responsible for your own belongings.
9. Fees
Attending an open casting is free. We do not charge a registration fee, an audition fee, or a fee to be considered. Our training programmes and portfolio services are separate, optional and paid, and their prices and terms are given to you before you commit to anything.
10. Liability
To the fullest extent permitted by Malaysian law, Evergreen Talents shall not be liable for any indirect or consequential loss arising from your participation in an open casting. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, and our total liability in connection with an open casting is limited to the maximum extent permitted by law.
11. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you register is the version that applies to that casting, and the latest version is always available here with its effective date.
12. Governing law
These terms are governed by the laws of Malaysia, and any dispute relating to them is subject to the jurisdiction of the Malaysian courts.
